Terms of Service

1. Acceptance of Terms

By accessing or using DSaaS services ("dsaas.xyz"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with these terms, you may not use our services.

2. Description of Services

DSaaS provides Linux infrastructure consulting, backup and archiving solutions, automation services, and related IT services, including:

• Linux server builds and infrastructure deployment (VPS, dedicated, physical hardware)
• Backup, archiving, and disaster recovery systems
• Business automation and AI integration (Zapier, Make, ChatGPT, Ollama)
• Container deployment and application hosting (Docker, Proxmox)
• System monitoring, security hardening, and maintenance
• NAS and storage solutions, VPN and remote access setup

3. Engagement Model

DSaaS operates on a flexible, ad-hoc basis. No long-term contracts or retainers are required. Services are provided per project or on an ongoing support basis as mutually agreed.

4. Acceptable Use

You agree not to use our services to:

• Violate laws or regulations
• Transmit malware or harmful code
• Engage in unauthorized access or security breaches
• Host illegal content
• Overload or disrupt infrastructure

5. Service Availability & SLAs

We strive for high availability but do not guarantee uninterrupted service. We may perform scheduled maintenance with advance notice or suspend services for emergency repairs. Service Level Agreements (SLAs) are defined in separate commercial agreements.

6. Payment Terms

Service fees are outlined in project quotes or service agreements. Fees are due according to agreed billing cycle. Late payments may result in service suspension. You are responsible for all applicable taxes.

7. Intellectual Property

DSaaS retains rights to its methodologies and tools. You retain ownership of your data and content. Custom work created specifically for you is licensed to you as agreed in the project scope.

8. Data Protection & Privacy

Our collection and use of personal information is governed by our Privacy Policy. We implement industry-standard security measures to protect your data.

9. Limitation of Liability

To the maximum extent permitted by law, DSaaS shall not be liable for:

• Indirect or consequential damages
• Loss of profits, data, or business opportunities
• Service interruptions or third-party actions

Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

10. Termination

Either party may terminate with appropriate notice. Upon termination, access to services ceases, outstanding fees remain due, and data may be deleted after a reasonable period.

11. Changes to Terms

We may modify these terms with reasonable notice. Continued use after changes constitutes acceptance of new terms.

12. General Provisions

These terms constitute the entire agreement. If any provision is unenforceable, remaining provisions remain in effect. Failure to enforce a provision does not constitute a waiver.
